Acceptance of terms

By accessing or using The Sound Dept. website and services, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms constitute a legal agreement between you and Sound Dept Dallas ("we", "us", or "our").

Description of service

The Sound Dept. is a members-only recording studio in Dallas, Texas. We provide monthly membership plans that include studio access, priority booking, and related services for artists, producers, engineers, and labels.

Eligibility and authority

You must be at least 18 years old and have the legal authority to enter into this agreement. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated. Notify us immediately of any unauthorised use.

Payment, billing, and subscriptions

Memberships are billed monthly in advance. Payment is processed by our online reseller, Stripe.com. By subscribing, you authorise recurring charges until cancellation. Taxes are calculated and remitted by Stripe in accordance with local regulations.

Stripe Merchant of Record disclosure

Our order process is conducted by our online reseller Stripe.com. Stripe.com is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns.

Cancellation and termination

You may cancel your membership at any time through your account dashboard or by contacting Stripe. Your access continues until the end of your current billing period. We may suspend or terminate your access immediately for: material breach of these terms, non-payment, fraud or security risk, or repeated or serious policy violations.

Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

Intellectual property

All content, software, designs, trademarks, and branding on this site are owned by Sound Dept Dallas or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. You may not reverse engineer, redistribute, or resell any part of the service.

Acceptable use

You agree not to misuse the service, including but not limited to:

• Using the service for any unlawful purpose.
• Engaging in fraud, spam, or deceptive practices.
• Infringing intellectual property rights of others.
• Interfering with the security or integrity of the service (malware, probing, scraping).
• Sharing membership access with non-members or circumventing technical limits.

User content

Any audio, files, or other content you upload or create using our service remains your property. You grant us a limited licence to host and process that content solely for the purpose of providing the service to you.

Service level

We do not guarantee that the service will be uninterrupted, error-free, or secure. Studio availability is subject to prior bookings and maintenance schedules. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

Warranties and liability

The service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. Our aggregate liability is capped at the total fees you paid in the six months preceding the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), except where prohibited by law.

Indemnity

You agree to indemnify and hold harmless Sound Dept Dallas from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles. Any dispute shall be resolved in the courts located in Dallas County, Texas.

Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance.
